The Justice Department has spurned a federal judge’s order to produce documents to back its contention that an American citizen captured in Afghanistan is an enemy combatant and therefore not entitled to constitutional protections.

Lawyers for the department failed to meet a deadline today imposed by Judge Robert G. Doumar of Federal District Court in Norfolk, Va., to support their argument that the defendant, Yasser Esam Hamdi, did not merit legal representation or other rights typically guaranteed by courts in the United States.”
